Pomni is a platform for generating, managing, and sharing AI-generated media, including models, images, and workflows. The Service enables users (“Users”) to create visual assets, upload machine learning models, and collaborate with others.

2. Eligibility

• You are at least 18 years old,
• You have not been suspended or removed from Pomni,
• Your use complies with all applicable laws.

If you are registering on behalf of an organization, you confirm that you are authorized to agree to these Terms on its behalf.

3. Accounts and Registration

You may need to create an account. You agree to provide accurate, up-to-date information and maintain the security of your credentials. You are responsible for all activity under your account.

4. Payments and Monetization

4.1 Creator Monetization

If you publish content for purchase, you may set your own prices. Pomni may collect and report tax-related information as required by law.

4.2 Refunds

Refunds may be granted for:

• Ongoing technical issues
• Severely flawed outputs

We may refuse refunds if you violate our Terms or simply change your mind.

4.3 Payment Processing

Payments are processed by third parties. By purchasing, you agree to their terms and authorize us to charge your selected method of payment.

4.4 Subscriptions

Some features are subscription-based. These auto-renew unless canceled before your next billing cycle. You can manage this from your account or by contacting support.

5. User Content

5.1 Ownership and License

You retain ownership of your uploads. By uploading, you grant Pomni the rights necessary to operate and display your content.

5.2 Public vs Private

Public content may be visible and reused by others. Private content remains accessible to Pomni for operational and legal purposes.

5.3 Content Guidelines

You agree not to post or request content that:

• Depicts real individuals in mature scenarios without consent
• Promotes violence or illegal activity
• Involves minors or impersonation
• Uses AI to simulate nudity or remove clothing

Moderators may remove or flag content. Appeals are accepted via our appeal process.

6. Restrictions

You agree not to:

• Use the Service for unlawful or harmful purposes
• Violate IP rights
• Upload malicious content
• Harass or abuse users
• Automate interactions to manipulate the system

7. IP Rights

Pomni retains all rights to its software and brand. You may not reproduce or redistribute any part of the platform unless explicitly permitted.

8. Third-Party Services

Third-party integrations are subject to their own terms. Pomni is not responsible for problems caused by these services.

9. Copyright Complaints (DMCA)

10. Termination

We may suspend or terminate your account for violating these Terms. Your access will end and content may become unavailable.

11. Disclaimers

The Service is provided “as is.” We do not guarantee it will be error-free or uninterrupted. Use Pomni at your own risk.

12. Limitation of Liability

We are not liable for indirect or consequential damages. Our total liability is limited to the greater of $100 or the amount you paid Pomni in the past 12 months.

13. Arbitration and Dispute Resolution

Most disputes will be resolved via binding arbitration. You waive rights to class actions and jury trials. You can opt out of arbitration within 30 days of accepting these Terms.

14. Modifications

We may update these Terms. Material changes will be communicated in advance. Continued use implies acceptance of the new terms.

15. Miscellaneous

These Terms are governed by Delaware law. If a clause is unenforceable, the rest remains valid. Pomni may assign these Terms at its discretion.
